If a  car which is used in your company, job etc. was damaged not because of your fault, you can apply to a guilty party`s  insurer for refund of replacement vehicle rental. The conditions of refund are  - rental of car of the same or lower class and prove that car is indispensable for work or due to health issues. In order to get this refund, before renting a vehicle you have to sign the declaration and submit it to insurance company. Example of declaration:

 "Regarding: (case number).

 I declare that, due to damage inflicted on my vehicle I used to make a profit/cure (more details here), I am compelled to rent a replacement vehicle for a time of my car repair. There should be a insurer’s stamp with date of reception on your copy

Car repair may be time-consuming. First of all, you have to inform the guilty party`s insurer about the damage, inspection and protocol will be done after a couple of days. Files often are sent from one division of insurance company to another. After reception of a damage protocol, vehicle service will estimate the damages. Usually, certain parts are not in stock of car service and need to be imported. These processes can prolong car reparation up to several weeks, but reparation itself lasts only a couple of days. Insurance companies often count the time of repair  instead of car’s outage total time. You are deprived of the car already at the moment of the crash, not to mention the time of repair.

It’s worth to emphasize that the main financial responsibility during  the time of vehicle’s preparation to mending lies on the  insurer’s side. Sometimes, insurance companies try to determine the maximal cost of rental, no matter if it is  100PLN/day in the cheapest company or 500 PLN/day in most the expensive one. According to law, they cannot  choose car rental vendor, therefore  neither can they determine rental price. Remember, the one and the only limitation is that the car should be the same or of a lower class than your car which is serviced.

According to law,  (Civil code art. 361, 363, i 415, Minister of Finances decree - 24.03.2000r. Dz.U. Nr 26 poz. 310 about third-party insurance), insurer is obliged to make the injured feel no loss caused by an accident. Replacement vehicle rental and car’s repair are basic claims that can be made.

By making difficulties in dealing with simple matters, insurance companies build atmosphere of “satisfaction”. It means: we got your car mended – you should be happy, but the point is that you can claim for more – it’s guaranteed by the law and renting a replacement vehicle is one of the things that you can do. Many people do not think about other losses related to accidents – e.g. unfinished business. Making you feel comfortable after an unexpected event is the obligation  of an insurance company.
